Consultation on the smokefree elements of the Health Improvement and Protection Bill

In the White Paper, 'Choosing Health: Making healthy choices easier', there was a commitment to consult widely on the process of drawing up the detailed legislation on smokefree public places. This consultation fulfils that commitment.

The key areas covered in this consultation, where comments and responses would be particularly welcomed, are:

  • the definition of enclosed public place/workplace
  • the definition of prepare and serve food
  • exemptions in general
  • placing of signage
  • the offences, penalties and defences of non-compliance
  • enforcement of the legislation, and
  • timetable

How and when to respond

This consultation runs from 20 June 2005 until 5 September 2005. Responses should reach the Smokefree Legislation Team at the latest by 5 September 2005.

All information in responses, including personal information, may be subject to publication or disclosure in accordance with the access to information regimes (these are primarily the Freedom of Information Act 2000, the Data Protection Act 1998 and the Environmental Information Regulations 2004). If you want your response to remain confidential, you should explain why confidentiality is necessary and your request will only be acceded to if is appropriate in all the circumstances. An automatic confidentiality disclaimer generated by your IT system will not, of itself, be regarded as binding by the Department.

This consultation will be carried out in accordance with the Cabinet Office Code of Practice on written consultations.
