In some areas of the NHS incidents of nuisance or disturbance behaviour cause particular problems. This type of incident can cause significant problems for the NHS in terms of low staff morale, absenteeism and staff retention. Furthermore, this type of behaviour can escalate into more serious situations, such as physical assaults on staff, theft of NHS assets or damage to NHS property.

This consultation document proposes introducing new legislation to give NHS health bodies new powers to deal with individuals causing a nuisance or disturbance on NHS premises. This paper seeks comments on the need for such legislation and all aspects of its formulation and use.
