The consultation 'Proposals to exclude overseas visitors from eligibility to free NHS primary medical services' set out proposals for introducing a system of charges for those overseas visitors who would not be eligible to receive free NHS treatment and sought views on how such charges should operate. The White Paper 'Trust, Assurance and Safety' set out an ambitious programme for the reform of professional regulation, including the creation of responsible officers. The Department of Health's consultation, under the Better Regulation Executive's Consultation Code of Practice, on the content of regulations on the roles and responsibilities of responsible officers closed on 24 October 2008.
The purpose of the consultation was to help the Department test the thinking and advice of our expert group with a wider group and in doing so, we hoped to gain a clearer understanding of the issues and how they affect individuals and organisations. The views expressed will influence the development of draft regulations setting out the detail of responsible officers. This document sets out the Department’s formal response to the consultation and provides a full analysis of responses.

This document provides the Government's response to the consultation held during spring 2008 (The future regulation of health and adult social care in England: a consultation on the framework for the regulation of health and adult social care) on the new registration framework to be introduced from 2010. Following Professor Mike Richards’s report Improving access to medicines for NHS patients, and the Secretary of State’s announcement of a package of measures in response, designed to make more drugs available to NHS patients free of charge on the NHS, draft guidance was published for consultation. The Department received 146 consultation responses on this guidance, and was pleased to note the broad support for Professor Richards’ recommendations and the aims of the guidance. In response to specific issues raised in consultation, the final version of the guidance includes a number of changes which are explained in the accompanying Government response.

The Health and Social Care Act 2008 extended direct payments to adults who lacked the capacity to consent to their receipt. From August to November 2008 the Department of Health consulted on regulations implementing the extension. The consultation document set out the steps that will be taken in the rare instances where an organisation fails, either for clinical or organisational reasons. After considering the responses we have decided to include the regime for unsustainable providers in the Health Bill (2009).

The Department of Health consultation "Changes to arrangements for regulating NHS bodies in relation to healthcare associated infections for 2009/10" came to an end on 20 October 2008. The Department has now considered the responses to the consultation, and has reviewed policy on how NHS organisations will register with the Care Quality Commission against requirements regarding healthcare associated infections (HCAIs) in 2009/10.
