The NHS Injury Costs Recovery (ICR) scheme: Annual amendment in the tariff and ceiling of charges on 1 April 2008

  • Last modified date:
    26 February 2008

The tariff and ceiling on charges payable by compensators for the recovery of NHS charges under the NHS Injury Cost Recovery (ICR) scheme will be increasing on 1 April 2008. The increases will apply only to injuries sustained on or after that date.

The tariff and cap used when the ICR scheme was established on 29 January 2007 were the same as had been in place for the old Road Traffic Act recovery scheme.  Ministers decided that it would be inappropriate to uprate the tariffs in April 2007, so soon after the ICR scheme had come into effect.  This is therefore the first time that tariffs have been uprated under the ICR scheme and takes account of inflation for 2006/07 and 2007/08 to correct this.

Where the injured person is provided with NHS ambulance services, the charge is increased from £159 to £165 for each occasion. Where the injured person receives NHS treatment, but is not admitted to hospital, the charge is increased from £505 to £547. The daily charge for NHS in-patient treatment is increased from £620 to £672.  The maximum charge in respect of an injury is increased from £37,100 to £40,179.
