Revision to PFI guidance: Chapter 13 (Fair Treatment of Staff) and Appendix 1 (Observing TUPE)

These two documents supersede the respective chapter and appendix in the PFI guidance manual "Private Public Partnerships in the National Health Service".

'Fair Treatment of Staff' replaces Chapter 13 of Section 1 of the manual - Selection and Preparation of Schemes.  The main changes are to provide a detailed and prescriptive approach on how bulk transfers and GAD certification should be handled in relation to pension provisions for transferring staff.  It also proscribes the employment information required from bidders at PQQ and FITN.  It should be read in conjunction with the Treasury's A Fair Deal for Staff Pensions.  The Bulk Transfer element of this guidance should be implemented in accordance with the DH July 2005 PFI/LIFT Newsletter.  The guidance does not cover the Retention of Employment model.

'Outline of DH policy in relation to TUPE matters' replaces Appendix 1 of Section 4 of the manual 'Commercial Issues'.  The main changes are to provide more detail on what information should be supplied and the position on staff who are already employed by private sector contractors.  It should be read in conjunction with the Cabinet Office's guidance on good practice in staff transfers.
