Revision to PFI guidance - 'Fair Treatment of Staff' and observing TUPE

Two revisions to the main NHS PFI Guidance on this website are available on this website
- New Chapter 13 ('Fair Treatment of Staff') of Section 1 ('The Selection and Preparation of Schemes') Main changes are to provide a detailed and prescriptive approach on how bulk transfers and GAD certification should be handled in relation to pension provisions for transferring staff.
- New Appendix 1 ('Outline of NHS Executive policy in relation to TUPE matters') of Section 4 ('Commercial Issues') Main changes are to provide more detail on what information should be supplied and the position on staff who are already employed by private sector contractors.
Both these chapters supersede the respective Chapter and Appendix in the PFI guidance manual Private Public Partnerships in the National Health Service: The Private Finance Initiative, issued by the NHS Executive in 1999 and found on this website (first icon under the heading 'Guidance on PFI build projects').
