How do the new competencies for chair and non-executive appointments affect those who are already in post?

The competencies now being used in the recruitment of chairs and non-executive directors were developed after the Governing the NHS document clarified their role on NHS boards. The competencies are those which non-executives need to fulfil their role effectively. This year, competencies have been included in the performance appraisal forms as an optional extra. Some chairs and non-executives have found them useful in pinpointing development needs or areas of weakness. However, their use is not intended to replace the traditional assessment of an individual's contribution against their pre-set objectives.

I am confused about sick leave. Can you clarify if there is any guidance on the treatment of sick leave for chairs and non-executives?

In the unfortunate event that a non-executive director or chair becomes sick and are unable to undertake their normal duties, they continue to be a full board member and are entitled to their full remuneration. The commission has developed a policy and procedure for use where the performance of a chair or non-executive has apparently been hindered by ill health or where a chair or non-executive has been unable to attend meetings for a significant period due to ill health.

Under current regulations, the appointment of an individual who does not attend meetings for three months may be terminated by the NHS Appointments Commission. However, in the case of ill health, this provision is usually interpreted sympathetically and in accordance with the policy which involves the utilisation of occupational health advice.
