This Circular provides authorities with detailed information about implementation of section 40 of the Care Standards Act 2000, which brings small private children's homes within the scope of regulation. It also tells authorities about the commencement of section 41 of that Act, which means that in future it will be beyond doubt that the registration of children's homes may be cancelled even when those homes have ceased to operate during the course of enforcement action. This Circular is issued as statutory guidance under Section 7 of the Local Authority Social Services Act 1970.
