This circular should be read in conjunction with LAC(2004)14. Paragraph 5 of that circular advises that the Independent Review Mechanism does not apply to prospective adopters who are being assessed under the Intercountry Adoption (Hague Convention) Regulations 2003 (the 2003 Hague Regulations). This anomaly has been rectified through the Independent Review of Determinations (Hague Convention Adoptions and Miscellaneous Amendments) Regulations 2004, SI 2004/1868, (the IRD (HC) Regulations) which come into force on 20 August 2004.
Although many of the Department of Health's Children and Families functions have transferred to the Department for Education and Skills (DfES), these circulars will continue to be issued in the Local Authority Circular (LAC) series for the foreseeable future.
