The Mental Health Act 2007 inserted the deprivation of liberty safeguards into the Mental Capacity Act 2005. It is planned that the deprivation of liberty safeguards will come into force with effect from 1 April 2009. This briefing sheet summarises the safeguards as they will operate in England.
