Continuing healthcare and other benefits and you

This note explains what happens to your entitlement to social security and other benefits if you receive NHS continuing healthcare. If you are still have any concerns about your entitlement to benefits you should contact your local benefits office.

This information is correct as of 1 November 2007.

Part One: People living in their own home and receiving NHS continuing healthcare

  1. Your social security benefits are not affected when you receive NHS Continuing Healthcare in your own home.
  2. There are some wider non-social security funding sources which can be affected by NHS Continuing Healthcare being provided in your own home. Usually these are ones that are dependent upon some social services funding being in payment or services under social care-related legislation being in place.

    These include:
  • the Independent Living Funds (ILF). ILF entitlement is dependent upon some Social Services funding being part of the package. Where a person is assessed as being eligible for NHS Continuing Healthcare there is no social care funding and so there would be no eligibility. However there may be eligibility for joint packages of care and it is important to get individual advice on each case In addition some former residents of long-stay hospitals in receipt of NHS funding may be eligible. Details can be found on the ILF’s website ( www.ilf.org.uk ).
  • Supporting People funding is not automatically affected by receipt of NHS Continuing Healthcare funding as it is provided on a separate legislative basis to NHS or social care services. However the legislation does give a degree of discretion as to how Supporting People funding is utilised locally and it is important to liaise with the local Supporting People Commissioning Body.
