This guide is intended primarily to support local commissioner agreements with the independent sector.

The purpose of this guide and its model contracts is to:

  • help establish clarity of roles and expectations between commissioners and providers;
  • identify areas to be addressed in ensuring that patients/users receive a safe and appropriate service - with areas of risk addressed; and
  • provide a sound contractual agreement, which delivers value for money.

HOW TO USE THE GUIDE

This Guide is offered to commissioners as an aid to building a local contract for intermediate care, drawing on a menu of suggested paragraphs to suit local needs.

For ease of use, each of the contracts has been produced in its entirety, avoiding the need for extensive cross-referencing.

Each of the three types of contract is presented in a two column format.

  • The left-hand column states the issues that commissioners and providers need to be aware and take account of in their contracts.
  • The right hand column contains suggested paragraphs which might be used to address the issues within a local contract

The entire set of paragraphs constitutes a model contract which local commissioners may wish to use as they stand. Alternatively, a bespoke contract can be built up by excluding, modifying or adding paragraphs. Irrespective of the approach, it is recommended that all of the issues in the left-hand column be addressed.

The final version of the local contract should of course be subject to legal scrutiny and advice locally before it is used.
