In recent Private Finance Initiative (PFI) deals, issues have arisen in relation to what happens if a poorly performing service provider is replaced. In particular, it seems there is some confusion over how to interpret guidance published by HM Treasury in April 2003. The purpose of this note is to clarify how the guidance should be applied in NHS PFI schemes
