This note summarises the current position on NHS indemnity for NHS bodies involved in research. It is a guide to managing the risks associated with research that involves NHS staff and/or NHS patients, including their organs, tissues or data.

The Department of Health is reviewing NHS indemnity arrangements. These notes represent existing guidance as in 'HSG(96)48: NHS Indemnity - Arrangements for handling clinical negligence claims against NHS staff' and the associated good practice document. They do not attempt to pre-judge the current review.
