The European Commission has made enquiries about the sourcing of Fresh Frozen Plasma (FFP) in the NHS, and in particular the purchase of Solvent Detergent Virally Inactivated FFP (SDFFP) which is used in the treatment of thrombotic thrombocytopenic purpura. This product differs from other FFP products in being purchased from a manufacturer rather than supplied through the National Blood Service. At present the purchase of SDFFP is the responsibility of those NHS trusts which require it.
The Commission has specifically asked the UK to ensure that all future requirements for SDFFP are met by means of an open, transparent and non-discriminatory tendering process, compliant with the EU public procurement rules. All NHS trusts are therefore reminded of the need to demonstrably comply with the procurement rules in sourcing and purchasing this product, and to ensure that those responsible for these purchases are fully conversant with the rules. It is likely that the Commission will be particularly alert for any procurement of SDFFP which breaches or appears to breach the rules, and this would be likely to lead to infringement proceedings.
As NHS trusts will be aware, compliance with the appropriate procurement rules and EU Treaty principles is required for all purchases undertaken by NHS trusts. Of course, these rules do not adversely affect NHS trusts' ability to choose the supplier and product most appropriate for their needs.
